1. General Provisions
These General Terms and Conditions
(GTC) govern all legal relationships arising from
concluded between Philippe and Fatima Rouge (sellers) and their customers
(buyers) through the online shop, by email,
or by telephone. Any provision proposed by the buyer that conflicts with these
Terms and Conditions is expressly excluded. By accepting these General Terms and Conditions of Sale and
Terms of Use, you declare that you have reached the age of majority in
your country, state, or province of residence, and that you have given us your
consent to allow any minor in your care
to use this website.
2. Contracting Parties
In the event of a contract being formed,

3. Order and Delivery
This offer is non-binding and
available on the website www.rouge-vins.ch . The product
regarding the products is provided for illustrative purposes only and is
not binding. We reserve the right to make changes to prices or product ranges and
technical changes are subject to change. The online offer is valid
as long as it appears on the website and only while
while supplies last.
Orders and deliveries are only possible within Switzerland.
By placing an order via the online store and simultaneously accepting these Terms and Conditions, the customer
expresses their firm intention to enter into a contract. The contract is deemed concluded
when the buyer receives an order confirmation from the
seller via email. The delivery method and associated costs are indicated in the online store.
Information regarding availability and delivery times is non-binding. If an item
is not in stock, the buyer will be notified as soon as
possible regarding the delivery date. The seller cannot be held liable
for delivery delays caused by manufacturers or third parties.
Consequently, all delivery time estimates are provided without
guarantee and are subject to change at any time. Delivery is made
at the buyer’s expense and risk.
4. Pricing and Payment
Prices are listed in Swiss francs
(CHF), including VAT (currently 8.1%). Prices and terms are
subject to change, with the reference date being the day the buyer placed the order.
Payment for the ordered goods must be made in advance, either by credit card via PayPal or
by prepayment. In the case of online payment, the cost of the goods
will be charged on the day the order is received. The seller reserves the
right to exclude buyers from certain payment methods without providing
reason. Invoices are payable within 30 days of receipt. After the
second reminder, the seller reserves the right to charge a
collection fees of at least CHF 20.00 as well as collection costs. The seller reserves
the right to assign the debt to a collection agency.
Payment by credit card is governed by the contractual terms and the

Delivered goods remain the property of the seller until full payment of the amount due. The seller
is authorized to register a retention of title in the register of
. In the event that the buyer is late in paying the
purchase price, the seller is, among other things, authorized to withdraw from the contract and
to take the goods back into its possession.
5. Order Process
The ordering process proceeds as follows:

e) Confirm by clicking the "Next: Payment" button

payment and acceptance of the Terms and Conditions by clicking on “Order Now!”.
Once the order is
confirmed, the buyer cannot cancel or modify it.
6. Warranty and Liability
Any claim regarding a defect or an incomplete or late delivery must be submitted in writing to the seller
immediately, no later than 10 days after the delivery date. Hidden defects
must be reported in writing to the seller immediately, no later than
10 days after their discovery. Any buyer who fails to notify the seller of such defects
within the specified time limits will not be able to assert their rights. In the event of a defect and
after returning the affected goods, the buyer will be provided with
replacement item. If delivery of a replacement item
proves impossible, the seller shall refund the payment made to the buyer. In
addition, any request for a price reduction, termination of the contract, or
payment of compensation for consequential damages is expressly excluded to the extent
where permitted by law.
The buyer forfeits any rights under the warranty for defects in the event of improper use
of the goods. A defect resulting from normal use or
improper handling, or damage caused by the buyer or third parties
or a defect due to external circumstances (improper storage,
freezing, heat, humidity, improper storage, etc.) does not entitle the buyer
to terminate the contract or request replacement of the goods. The
seller shall assume no liability in this regard. Returns of
goods are made at the buyer’s expense and risk. The
products must be properly packed in their original packaging and
sent by registered mail. If the seller finds no defects covered by
its own warranty or that of the manufacturer, it is entitled to charge the costs
for the inspection and return shipping of the goods to the buyer.
Any other claims by the customer—regardless of the legal basis—are excluded, to the extent permitted by law
permits. The seller, its agents, and other persons working on
his service cannot be held liable for damages that do
occurred to the goods themselves, in particular consequential damages resulting from
a defect, loss of profit, or other financial losses suffered by
the buyer. To the extent permitted by law, the seller disclaims all
liability regarding the offer (including errors in illustrations,
text, and pricing) and to delivery.
Products ordered in error by the buyer will not be accepted for return or refunded.

7. Data Protection
The information required for the
transaction will be treated confidentially. The buyer agrees

8. Governing Law and Jurisdiction
The seller expressly reserves the right to modify these general terms and conditions at any time
and to have them take effect immediately.
All contracts concluded with the seller are governed by Swiss law, excluding the substantive rules of
private international law and the United Nations Convention on
Convention on Contracts for the International Sale of Goods (CISG). If the order is placed
from private individuals for personal use, the place of jurisdiction is determined in accordance with
provisions regarding consumer protection. In all other
cases, the exclusive venue is Epesses.
